Account termination may occur without prior notice or liability. You may terminate your account at any time by contacting us.

When you submit content to Cosmic Cassy, including stories, comments, or other materials, you retain ownership of your content. However, by submitting content, you grant Cosmic Cassy a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, and display your content in any media formats and through any channels, now known or hereafter developed, for the purpose of operating and promoting the site.

License Terms

• This license continues for as long as your content remains on the site

Note on Personal Experience Sharing: Sharing your personal experience with a resource, treatment, or organization is encouraged and is the heart of this community. What is prohibited is presenting personal experience as professional medical advice or making clinical claims. There is a meaningful difference between telling families what helped you and telling families what they should do medically.

We reserve the right to remove any content that violates these standards or for any other reason, with or without notice. Repeated violations may result in account suspension or termination.

You may not use automated tools, bots, scrapers, crawlers, or any other automated means to access, collect, or extract data from Cosmic Cassy without our express written permission.

Prohibited Activities

• Using bots, spiders, scrapers, or automated scripts to access or download content from the site

Consequences of Violation

Organizations or researchers interested in accessing our data for legitimate purposes must contact us at admin@cosmiccassy.org to discuss access or partnership opportunities. We reserve the right to monitor access patterns and take action against suspicious activity.

We reserve the right, but have no obligation, to monitor, edit, or remove any user content at any time for any reason without notice or liability.

Content Moderation

Effects of Termination

• Location: Arbitration shall take place in South Carolina or remotely via videoconference if mutually agreed
• Arbitrator: One arbitrator shall be selected according to AAA rules
• Costs: Each party shall bear its own costs and expenses of arbitration, including attorney fees, unless the arbitrator awards such costs to the prevailing party
• Filing Fee: The filing fee shall be split equally between the parties
• Discovery: Discovery shall be limited as determined by the arbitrator to ensure efficient and cost-effective proceedings
• Final Decision: The arbitrator's decision shall be final and binding. Judgment on the arbitration award may be entered in any court having jurisdiction

Exceptions to Arbitration

Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.

Opt-Out of Arbitration

You may opt out of this arbitration provision by sending written notice to admin@cosmiccassy.org within 30 days of first using the site. If you opt out, disputes will be resolved in court as described in the Governing Law section.

You agree that any proceedings to resolve disputes will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Waiver Details

• You waive any right to participate in a class action lawsuit against Cosmic Cassy
• You waive any right to participate in class-wide arbitration
• Claims may only be brought in your individual capacity
• You may not act as a representative or seek relief on behalf of a class or group
• The arbitrator may not consolidate more than one person's claims
• The arbitrator may not preside over any form of representative or class proceeding

If this class action waiver is found to be unenforceable, then the entirety of the Dispute Resolution and Arbitration provision shall be null and void, and disputes will be resolved in court.

These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions.

Jurisdiction

• Any legal action or proceeding arising under these Terms that is not subject to arbitration shall be brought exclusively in the state or federal courts located in South Carolina
• You consent to personal jurisdiction in such courts and waive any objection to venue
• You waive any claim that South Carolina is an inconvenient forum

International Users

If you access Cosmic Cassy from outside the United States, you do so at your own risk and are responsible for compliance with local laws. To the extent federal law applies, these Terms shall be governed by federal law.

We reserve the right to modify these Terms at any time.

How We Notify You of Material Changes

• Posting the updated Terms on this page with a new effective date
• Sending an email notification to all registered users
• Displaying a prominent notice on the site for 30 days

Acceptance of Changes

• Your continued use of the site after changes are posted constitutes your acceptance of the modified Terms

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.
